After a short summer break, Adan is preparing for a rich and busy fall. While at the European level, the debates on MiCA and the pilot regime are still dragging on and mobilising us, the work on the strengthening of the anti-money laundering and countering the financing of terrorism framework, based on the new package of the European Commission, is just beginning. Especially as the FATF’s conclusions – from its spring consultation – are expected soon. At the national level, accounting and tax issues are hot topics as the initial text of the Finance Bill is being prepared: we are proposing numerous improvements to refine the existing framework and promote the financing of the real economy. The VASP regime is not left out for this: helpful clarifications must be provided to the actors, and we are working on drafting a practical guide to help applicants for registration understand the content and the proper application of their AML/CFT obligations. We are pleased that the white list is growing – today, 22 VASPs are registered – but many companies are still waiting for their turn! Giving them the keys to get better prepared for the constitution of their application, and more certainty during the instruction, is part of the solution.

Following the positive momentum of our Crypto Finance Forum on 19 July, the replay of which can now be found on our Youtube channel, the Association’s educational activities remain intense. To be aware of the wide scope of companies and activities developed thanks to blockchain technologies and cryptoassets, to better understand the regulations they comply with, to answer questions about the future impact of this innovation (digitisation of finance, new services, revolution in exchanges, environmental issues, etc.): the Association is in great demand – thank you to SurfinBitcoin, the BSmart channel and ANACOFI for being vectors of this essential pedagogy. Crypto-blockchain use cases to improve the energy transition

This new educational article briefly presents different projects – based on blockchains and crypto-assets technologies – that facilitate the ecological transition. It does not aim to question the energy consumption of the crypto-asset industry but helps bring a new angle to the debate on the environmental footprint of crypto-assets.

The month of August saw an increase in the number of institutional works and meetings, including:

  • [LCB-FT] L’Association prépare un projet de guide méthodologie pour aider les PSAN à comprendre leurs obligations en matière de lutte contre le blanchiment et le financement du terrorisme, et les appliquer en pratique ;

  • [PSAN] Le Comité juridique et fiscal de l’Adan a travaillé cet été à la rédaction d’une note d’analyse concernant les incertitudes relatives au statut PSAN, notamment le cumul avec d’autres autorisations ou la qualification de certains services ;

  • [Crypto-asset taxation] Adan is currently putting forward its proposals for improvements to the taxation of crypto-assets in the context of the forthcoming Finance Bill.

European focus

August enabled us to make progress on many cross-cutting issues and to carry out various actions at the European level:

  • [LCB-FT] En juillet, la Commission européenne a révélé 4 propositions de règlement visant à renforcer les règles et la supervision des acteurs en matière de lutte contre le blanchiment de capitaux et le financement du terrorisme. L’Adan analyse actuellement l’impact de cet AML-CFT legislative package pour l’industrie des crypto-actifs.

  • [General regulatory adjustments] The Association responded to the consultation Insights to EU regulatory efforts in the blockchain technology domain of B-Hub for Europe, an initiative of the Start-up Europe Programme of the European Commission’s DG Connect. This consultation aimed to understand how current regulation is adapted or not to the specificities of blockchain technologies and to collect recommendations on necessary adjustments.
